As is the case in most states in the United States, the regulations governing online betting in Florida are a little bit complicated, and the answer to the question of “Is betting illegal in Florida?” would be… it depends.

When it comes to betting in person, residents of Florida have the option of going to one of the state’s tribal casinos, participating in pari-mutuel betting, or playing slot machines at one of the pari-mutuel facilities located in Miami-Dade County or Broward County. So, what exactly are the regulations that Florida has in place regarding online betting?

Is Online Betting In Florida Legal?

The state of Florida currently doesn’t allow any type of online betting. The Seminole Tribe was permitted to provide online sports betting to folks in the state, in addition to in-person sports betting in their venues, thanks to a  Florida internet gambling bill that made it legal for an instant in Florida in 2021.

Sadly, a federal judge would revoke Florida’s agreement with the Seminole Tribe about casinos. The tribe has since appealed the ruling but has also shut down all Florida-based wagering in its sportsbook. Since the legal state of Florida sports betting is constantly changing, one needs to be updated regularly to avoid breaking any laws.

Florida still does not allow online casino games until they have resolved the appeal. However, there are offshore casino sites where you may play casino games in Florida which are extremely convenient as they don’t even require any downloads, saving you from wasting disk space.

Therefore, to answer the question, “Does Florida allow online casino gaming? Although the state doesn’t strictly allow it, the answer is yes.

Legal Betting Age In Florida

When considering betting in Florida, you may wonder how old you must be to bet legally in Florida.  Well, in Florida, you must be 21 to enter a casino or play slots, but you may play poker as early as age 18.

Additionally, the minimum age for pari-mutuel wagering is 18. The legal betting age in Florida will be 21 once legal sports betting is available there. However, all Florida offshore internet gambling companies permit players 18 and older to play online casino games and make sports wagers.

Using Real Money To Bet

Using Real Money To Bet

Online bets utilizing real money are quite popular amongst Floridians. When the state makes betting on sports online legal, there will be a significant increase in the number of people doing so. There is also the option to play at online casinos. It offers free gameplay, letting you play without using any real money.

In addition, it is great for people trying to get a feel for the game. But it is not suitable for people looking to win money, as free play does not feature any rewards.

Are Winnings Taxable?

Because Florida does not have a state income tax, sports bettors who win more than $600 from gambling will only have the requirement to pay the federally imposed tax rate of 24% on their earnings. Fortunately, losses incurred when betting can cancel out these wins.

Next Steps For Florida

The Seminole Tribe is the major barrier to the state of Florida moving forward with licensing online and sports gambling. The Seminole Tribe has a monopoly on all casino card games according to the existing deal that is in place. This includes games like Blackjack, Roulette, and Slots.

Legislators around the state are extremely worried about the potential negative effects of legalizing online sports betting. It also includes other forms of gambling in the Seminole gaming sector.

The possibility of adverse effects on the Seminole Tribe acted as the impetus for an enlarged agreement. It is to be negotiated between the Seminole Tribe and the state of Florida. After receiving approval from both houses of the legislature and the signature of Governor DeSantis, they finalized the agreement in May 2021. However, Judge Friedrich eventually decided that the agreement was invalid.

With three National Football League clubs, two Major League Baseball teams, two National Basketball Association teams, and two National Hockey League teams, Florida is one of the most popular regions in the United States for spectator sports. Additionally, college football is becoming even more popular.

With teams such as the Florida Gators, Florida State Seminoles, and Miami Hurricanes, it paves the way in viewership. Should there be regulations in place, sportsbooks would stand to gain a significant amount of revenue. The activity of sports betting would gain substantial amounts of fame in the state.

Our Conclusion

Although Florida’s laws on online gambling are utterly hectic, it creates a lot of confusion for Floridians considering online betting. Thankfully, many off-shore sportsbooks allow individuals from anywhere to place bets and win money!
